How to Outline a Bar Exam Essay Before You Write

Bar Exam Doctor · Published November 2, 2026 · Expanded with a worked example November 2, 2026

A useful essay outline is a route through the answer, not a miniature treatise. Its purpose is to prevent omissions, put related issues together, and protect enough time for factual analysis.

Create a small structure first

Begin with the requested parties or questions. Under each, place the main issues in a sensible order. Keep the outline brief enough to scan while writing. Copying complete rule paragraphs into scratch work can leave you with less time to explain the facts in the answer itself.

Add rule and fact reminders

Under a difficult issue, note the requirement that needs analysis and one or two decisive facts. Use a symbol for a defense, exception, or competing inference. You are creating prompts for your reasoning rather than drafting polished prose twice.

Set a transition point

Use practice to learn when planning has become avoidance. Choose an initial planning budget, write a complete response, and then evaluate whether the outline improved coverage and completion. Adjust the budget based on actual performance rather than treating one timing split as universally correct.

Worked example

A usable scratch outline

A practice question has two expressly requested parts. The first turns on timing and the second on the identity of the recipient. Your planning notes should preserve that division without drafting the answer twice.

Starting approach

Copy the entire rule paragraph, rewrite the chronology in full, and then begin the first requested part.

A stronger approach

Part 1—timing: receipt standard; Thursday sent/Saturday received; competing inference? Part 2—recipient: named person versus assistant; check supplied exception; conclude separately. Mark the point at which drafting must begin.

Why the change matters

The compressed outline gives you places for the governing standard, important facts, and uncertainty. During review, ask whether each note helped produce an actual paragraph. If you wrote detailed notes that never made it into the answer, examine the transition to drafting. If you drafted quickly but omitted Part 2, make the requested-part headings more visible.

Common mistake: An elegant outline is not a completed answer; preserve time to explain the facts in the response itself.

Try this in your next session

Outline a question on one sheet with no complete paragraphs. Write the answer using that sheet. Afterward, mark which outline notes helped and which consumed time without changing the response.
